A Cumberland County jury has returned a guilty verdict on felony drug charges against defendant Devontay McFadden. On December 7, 2022, a jury convicted McFadden of one count of felony Possession with Intent to Deliver Fentanyl, a Schedule II controlled substance, and one count of felony Possession with Intent to Deliver ANPP, a Schedule I controlled substance. The Defendant was also convicted of one count of Unlawful Possession of Drug Paraphernalia, a misdemeanor. The jury’s verdict came at the conclusion of a trial held before the Honorable Judge Albert H. Masland.
The charges in this case stem from the execution of a lawfully issued search warrant conducted at McFadden’s apartment in Silver Spring Township on April 9, 2021. On that day, officers discovered a substantial amount of fentanyl and ANPP in McFadden’s coat pocket. Officers also discovered drug-related paraphernalia in the residence and a large amount of money (consistent with drug dealing) in McFadden’s clothing. After the fentanyl/ANPP was discovered, McFadden made a statement admitting to knowledge of the drugs.
The case was prosecuted from by Senior Assistant District Attorney Daniel Tarvin and by Detective Anthony Fiore of the Cumberland County Drug Task Force. The prosecution team at trial included Senior Assistant District Attorney Nichole Vito.
Sentencing in this case is scheduled for Tuesday, January 10, 2023 before Judge Masland.
