On August 31, 2022, defendant Devontay McFadden was convicted by a jury of one count of Delivery of Fentanyl and one count of Delivery of Heroin. The jury’s verdict was reached after a two-day trial before the Honorable Judge Albert H. Masland.
The charges in this case stem from a sale of drugs that occurred in Silver Spring Township on February 27, 2021. On that day, the Defendant negotiated with another person to sell that individual a bundle (10 bags) of suspected heroin. The Defendant then completed the drug deal from the Defendant’s own residence. Lab tests confirmed that the drugs consisted of not only heroin, but fentanyl – an extremely dangerous substance significantly more potent than heroin.
The case was prosecuted from start to finish by Senior Assistant District Attorney Daniel Tarvin and by Detective Anthony Fiore of the Cumberland County Drug Task Force. The prosecution team at trial included Lead Senior Law Clerk Mitchell Snyder.
Sentencing in this case is scheduled for Tuesday, November 8 before Judge Masland.
