On January 10, 2023, defendant Devontay McFadden entered a guilty plea to one count of Delivery of Controlled Substance – Fentanyl and one count of Delivery of Controlled Substance – Heroin in two separate cases that arose out of two separate criminal incidents in the spring of 2021. The Defendant was immediately sentenced by the Honorable Judge Albert H. Masland. The pleas and sentences conclude a lengthy investigation and prosecution of McFadden by the Cumberland County Drug Task Force that stretched nearly two years.
The investigation into McFadden began in February 2021, when the Drug Task Force responded to an overdose death that had occurred in Enola, Cumberland County, PA. Detectives soon learned as part of that investigation that McFadden had sold drugs to an acquaintance of the overdose victim on February 27, 2021, one day before the overdose victim was found dead. The Drug Task Force then conducted two controlled purchases of drugs from McFadden in March and April 2021. The investigation culminated with the execution of a search warrant at McFadden’s residence on April 9, 2021, which yielded a large amount of fentanyl found in McFadden’s coat pocket.
The Commonwealth filed charges against McFadden that resulted in four separate cases – covering the three drug sales and the charges stemming from the April 2021 search warrant. In August 2022, a trial was conducted regarding the February 2021 drug sale, after which the Defendant was convicted of two counts of Delivery of Controlled Substance (Heroin and Fentanyl) and later sentenced to 2.5 to 7 years in state prison. In December 2022, a trial was conducted pertaining to the April 2021 search warrant, after which the Defendant was convicted of Possession With Intent to Deliver a Controlled Substance – Fentanyl. The Defendant received a sentence of 6-12 year state prison on that case.
With these pleas at the last two dockets (encompassing the March 2021 and April 2021 drug sales), the Defendant will serve a total of 8.5 to 19 years in state prison as a result of the criminal conduct that led to the prosecution of these four cases.
The cases were prosecuted by Senior Assistant District Attorney Daniel Tarvin and by Detective Anthony Fiore of the Cumberland County Drug Task Force. Other members of the Drug Task Force made significant contributions in this investigation and prosecution. The Drug Task Force was also assisted by several other law enforcement agencies, including the Silver Spring Township Police Department and the East Pennsboro Police Department.
